"North Crest Group" (also "North Crest", "we", "us" or "our") is a trading name used by a group of affiliated companies, each independently authorised by its local regulator. The website northcrestgroup.com is owned and operated by North Crest Capital Holdings Ltd. By accessing the website or using any of our services, you confirm that you have read, understood and agree to be bound by these terms.
If you open a live trading account, you will contract with one of our regulated operating entities, determined by your country of residence. The client agreement issued by that entity governs your trading relationship with us. Where these terms and your client agreement conflict, the client agreement prevails for trading services; these terms continue to govern your use of the website itself.
These terms should be read together with our Privacy Policy, which explains how we handle your personal data, and our Risk Disclosure, which describes the risks of trading leveraged products. If you do not agree to these terms, do not access the website or use our services.
Description of Services
North Crest provides online trading services in contracts for difference (CFDs) on forex, indices, commodities, shares and cryptocurrencies. Access is provided through our trading platforms and the account management tools available on the website.
Alongside trade execution, we make available live pricing, charts, trading calculators, market commentary, educational resources, demo accounts and customer support. Demo accounts simulate trading in a risk-free environment; pricing, execution speed and order behaviour on a demo account may differ from live market conditions, and demo results are not a reliable indicator of live performance.
Our services are provided on an execution-only basis. North Crest does not provide investment advice. Nothing on the website, in our platforms or in our communications constitutes a personal recommendation, investment advice or a solicitation to enter into any transaction. You are solely responsible for your trading decisions and should seek independent professional advice if you are unsure whether a product is appropriate for you.
Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services. By registering, you represent and warrant that you meet these requirements and that all information you provide to us is accurate.
Our services are not directed at, and may not be used by, any person in a jurisdiction where the distribution or use of our services would be contrary to local law or regulation, or where no North Crest entity holds the authorisation required to serve that person. Your country of residence determines which of our regulated operating entities, if any, may onboard you as a client. We may decline an application at our discretion and are not obliged to give reasons.
You further represent that you are acting on your own behalf and not for an undisclosed third party, that the funds you deposit are lawfully obtained and belong to you, and that you are not subject to any sanctions or legal restrictions that would prohibit you from dealing with us.
Account Registration
To trade with North Crest you must register for an account. You agree to provide accurate, current and complete information during registration and to keep that information up to date for as long as you hold an account with us.
Before your account is activated for live trading, we are required to verify your identity and, where applicable, the source of your funds in line with anti-money-laundering and know-your-client obligations. We may request identification documents, proof of address and other supporting information, and we may restrict or refuse account functionality until verification is complete. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@northcrestgroup.com if you suspect unauthorised access to or use of your account. Unless we agree otherwise, you may hold only one live trading account per operating entity.
Trading Rules and Risks
CFDs are complex, leveraged instruments and carry a high risk of losing money rapidly. 72% of retail investor accounts experience capital loss when trading CFDs with this provider. Before trading, you should consider whether you understand how CFDs work and whether you can afford to take the high risk of losing your capital.
Leverage magnifies both gains and losses. You must maintain sufficient margin to keep positions open; if your account equity falls below the required margin level, some or all of your positions may be closed automatically without further notice. Market prices can move rapidly and can gap through your chosen levels, which means orders, including stop orders, may be executed at a price different from the one you requested. Liquidity, spreads and execution conditions vary by instrument and by market session.
All trading decisions are yours alone, made on your own judgement. Past performance is not a reliable indicator of future results, and nothing we publish guarantees any trading outcome. Fees and Charges
You agree to pay all fees and charges that apply to your account and your trading activity. Our principal trading charges are spreads, any applicable commissions and overnight funding (swap) adjustments on positions held open across the daily rollover. The charges applicable to each instrument are set out in the contract specifications and fee information published on the website.
Non-trading charges may also apply, including currency conversion costs where you trade instruments denominated in a currency other than your account currency, inactivity fees on dormant accounts, and any fees levied by third-party payment providers when you deposit or withdraw. Where such charges apply, they are described in our published fee information and may be deducted directly from your account balance.
We may change our fees and charges from time to time. We will give you prior notice of changes through the website or by email before they take effect, and your continued use of our services after that point constitutes acceptance of the revised charges.
Prohibited Activities
You agree not to use our website or services for any unlawful purpose, and in particular not to engage in market abuse or manipulation; abusive trading strategies designed to exploit pricing latency, system errors or manifestly erroneous quotes; the use of any automated system, robot or scraper to access the website or platforms without our prior written consent; copying, redistributing or disclosing any part of the service or its data; reverse engineering or attempting to derive the source code of our platforms; or any attempt to probe, interfere with or compromise the integrity or security of our systems.
You further agree not to misrepresent your identity or country of residence, open or operate accounts on behalf of undisclosed third parties, use multiple accounts to abuse promotions or bonus terms, or use our services to launder money or finance unlawful activity.
If we reasonably determine that you have engaged in a prohibited activity, we may void or reverse transactions attributable to that activity, withhold gains derived from it, suspend or terminate your account, and report the conduct to the relevant regulator or law-enforcement authority. These remedies are in addition to any other rights available to us under your client agreement or applicable law.
Intellectual Property
All content and materials on the website and our platforms, including text, graphics, logos, icons, images, audio, video, software, platform code, trading tools and the "North Crest" and "North Crest Group" names and marks, are the property of North Crest Capital Holdings Ltd, its affiliates or its licensors, and are protected by copyright, trademark and other intellectual-property laws.
We grant you a limited, revocable, non-exclusive and non-transferable licence to access and use the website and platforms for your personal, non-commercial use in connection with your account. You may not copy, modify, distribute, sell, sublicense or create derivative works from any part of our services without our prior written consent.
Market data, quotes and other financial information displayed through our services may be supplied by third-party licensors. Such data is provided for your personal trading use only and may not be redistributed, republished or used to construct competing products or services.
Privacy
Your use of our services is also governed by our Privacy Policy, a companion document to these terms, which explains what personal data we collect, why we collect it, how long we keep it, who we share it with and the rights you have over it. By using our services you acknowledge that your personal data will be processed as described in the Privacy Policy.
As a regulated business, we share certain client data with identity-verification providers, payment processors and the regulators that supervise our operating entities, in each case as described in the Privacy Policy. Termination
You may close your account at any time by contacting support, subject to first closing any open positions and settling any amounts you owe us.
We may suspend or terminate your account, or restrict access to some or all of our services, where you materially breach these terms or your client agreement; where we reasonably suspect market abuse, fraud or money-laundering; where we are unable to complete required identity or source-of-funds verification; or where we are required to do so by law, by a regulator or by a court. Where lawful and practicable, we will give you notice before taking such action.
On termination, your right to access the services ends. Open positions may be closed at prevailing market prices, and any remaining balance will be returned to you after deduction of amounts owed and completion of any checks we are required to perform. Termination does not affect rights and obligations accrued before the termination date, and any provisions of these terms that by their nature should survive termination will do so.
Disclaimer of Warranties
The website and our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, North Crest disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the website or platforms will be uninterrupted, timely, secure or error-free, or that defects will be corrected.
Market data, prices, analysis, commentary and educational materials are provided for information only. They may be sourced from third parties, may be delayed and may contain errors or omissions. We make no warranty as to their accuracy, completeness or timeliness, and they do not constitute investment advice or a recommendation.
Nothing in this section excludes or limits any warranty, right or protection that cannot be excluded or limited under applicable law, including any mandatory client protections in the jurisdiction of the North Crest entity you contract with.
Limitation of Liability
To the maximum extent permitted by applicable law, neither North Crest Capital Holdings Ltd nor any of its operating entities, directors, employees, partners, agents, suppliers or affiliates shall be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of data, loss of use, loss of goodwill or other intangible losses, arising out of or in connection with your use of, or inability to use, the website or our services.
We are not liable for losses arising from your own trading decisions, from ordinary market movements, or from events beyond our reasonable control, including failures of telecommunications networks, third-party data feeds, payment systems or internet infrastructure. You acknowledge that trading losses are an inherent risk of leveraged products and are borne by you.
Nothing in these terms excludes or limits our liability for fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law or under the regulatory obligations of the North Crest entity you contract with.
Governing Law
These terms are governed by and construed in accordance with the laws of Mauritius, the seat of North Crest Capital Holdings Ltd, without regard to conflict-of-law provisions.
This choice of law is without prejudice to any mandatory client protections available to you in the jurisdiction of the North Crest operating entity you contract with. Your client agreement may provide that the laws and courts of that entity's jurisdiction apply to your trading relationship; where it does, the client agreement controls for trading services.
Our failure to enforce any right or provision of these terms is not a waiver of that right or provision. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
Changes to Terms
We may modify or replace these terms from time to time, for example to reflect changes in law or regulation, changes to our group structure or changes to the services we offer. The current version is always available on the website.
Where a change is material, we will give you reasonable advance notice through the website or by email before the revised terms take effect. Your continued use of the website or our services after a revision takes effect constitutes acceptance of the revised terms. If you do not agree to a revision, you should stop using the services and may close your account.
